Terms of trade

The terms formulated in these trading and delivery conditions apply to deliveries from Clutch Cognition ApS. If other terms and conditions are explicitly agreed between buyer and seller, they apply instead of the following.

 

Orders

Orders can be placed online via the webshop at https://clutchcognition.com/shop/ – all hours of the day and all year round. As soon as you receive an order confirmation from us per e-mail, a binding purchase agreement has been entered. Until you receive your order confirmation, we may cancel your order in whole or in part, e.g. as a result of sold out items or missing information. If we must cancel your order, we will inform you by e-mail or telephone.

 

Subscription service

To subscribe to our products and/or services you warrant that you are legally capable of entering into binding contracts yourself or in case of a business to business case, on behalf of the company you are representing and/or working at, and that you are at least 18 years old.

 

Business to consumer*: The B2C subscription plan typically consist of an initial charge (sign-up fee) and then followed by recurring period charges as agreed to by you. Business to business: The B2B subscription plan consist of recurring period charges as agreed to by you and / or on behalf of a company.

 

By entering into this Agreement, you acknowledge that your subscription has a recurring payment feature and you accept responsibility for all recurring charges prior to cancellation. Clutch Cognition ApS may submit periodic charges (e.g., monthly) without further authorisation from you, until you provide prior notice that you have terminated this authorisation or wish to change your payment method. To terminate your authorisation or change your payment method, log into “My account” and manage your automatic subscription payment under the ‘Subscription’ link. Clutch Cognition cannot change or cancel this for you. If you experience any problems with your subscription service please write to support@clutchcognition.com – if you decide to terminate on written request (which generally do not recommend) it will not affect charges submitted before Clutch Cognition reasonably could act (7 days prior to charge).

 

By subscribing to our Services you are agreeing to pay recurring periodic subscriptions for an indefinite time until cancelled by you, on the subscription terms set out in this agreement. You can cancel your subscription at any time. You will not be charged for any cancellation. You can re-subscribe at any time following your cancellation, but we reserve the right not to permit re-subscription where we have previously elected to terminate a subscription by you.

 

We reserve the right at our absolute discretion not to renew your subscription at any time without giving any reasons for our decision.

 

Payment and price

Via the webshop you can pay for your goods and use the following payment options:

 

VISA (VISA Electron), Mastercard (Mastercard Debit), Apple Pay, Google Pay, PayPal and MobilePay. Companies can place a purchase order (PO) and pay via invoice.

All prices on https://clutchcognition.com are in DKK incl. VAT.

 

The amount is only redeemed when the goods are sent from our warehouse. An amount greater than what you have approved at the time of purchase can never be redeemed.

 

We always try and ensure that all prices on our website are accurate, but in case we discover an “obvious error” in the price of goods you have ordered, we may inform you and provide you with the option of reconfirming your order at the correct price, adjusting it, or simply cancelling it. If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund.

 

Delivery

Delivery of goods ordered from Clutch Cognition ApS is considered to have taken place when you as the buyer have received the goods. The risk and responsibility for the product is only transferred to the buyer upon delivery of the product.

 

Delivery is possible with Postnord and GLS to the nearest parcel shop, private address, business address or at another designated storage location. Delivery to a private address typically takes place within 2-4 working days in Denmark. For companies (B2B deals) the products is typically delivered within 5 working days for Denmark (delivery by freight forwarder).

 

Right of return and cancellation

We do not grant a right of withdrawal on beverages, in accordance with the Danish Consumer Contracts Act §18 Subsection 2. This is for quality and hygiene reasons, as we will not be able to guarantee that the product has been stored properly after delivery, thereby making the product unsellable.

 

Complaints and grievances

Any errors or defects in items purchased from Clutch Cognition ApS must be informed within a reasonable time after you have discovered the error. It is your duty as a consumer to state and show how the error or defect manifests itself. If you discover an error, you must quickly contact Clutch Cognition ApS, and then we will try to resolve it in the best possible way. Vilkårene formuleret i denne handels- og leveringsbetingelser gælder for leverancer fra Clutch Cognition ApS. Hvis andre vilkår og betingelse er indgået skriftligt mellem køber og sælger gør de sig gældende.

 

Ordre

Ordrer kan afgives online via. webshoppen på https://clutchcognition.com i alle døgnets timer og året rundt. Så snart du modtager en ordrebekræftelse fra os pr. e-mail, er der indgået en bindende købsaftale. Indtil du modtager din ordrebekræftelse, kan vi annullere din ordre helt eller delvist, f.eks. på baggrund af udsolgte varer eller manglende information. Hvis vi er nødsaget til at annullere din ordre, informerer vi dig via e-mail eller telefon.

 

Subscription service

For at abonnere på vores produkter og/eller tjenester garanterer du, at du er juridisk i stand til selv at indgå bindende kontrakter eller i tilfælde af en business to business case på vegne af den virksomhed, du repræsenterer og/eller arbejder hos, samt at du er mindst 18 år gammel.

 

Business to consumer*: B2C-abonnementsplanen består typisk af en startafgift (et tilmeldingsgebyr) og derefter efterfulgt af tilbagevendende betalinger efter aftale.

Business to business: B2B-abonnementsplanen består af tilbagevendende betalinger efter aftale med dig og/eller på vegne af en virksomhed.

 

Ved at indgå denne aftale bekræfter du, at dit abonnement består af tilbagevendende betaling, og du accepterer ansvaret for alle tilbagevendende betalinger før en annullering. Clutch Cognition ApS kan trække periodiske betalinger (f.eks. månedlige) uden din yderligere autorisation, indtil du på forhånd giver besked om, at du har opsagt denne autorisation eller ønsker at ændre din betalingsmetode. For at anullere din godkendelse eller ændre din betalingsmetode skal du logge ind på “Min konto” og administrere dine automatiske abonnementsbetalinger under linket ‘Abonnement’. Clutch Cognition kan ikke ændre eller annullere dette for dig. Hvis du oplever problemer med din abonnementstjeneste, bedes du skrive til support@clutchcognition.com – hvis du beslutter dig for at opsige på skriftlig anmodning (som vi generelt ikke anbefaler), vil det ikke stoppe den betaling, der er i proces, før Clutch Cognition med rimelighed kunne nå at reagere (7 dage før betalingsfristen).

 

Ved at abonnere på vores tjenester accepterer du tilbagevendende betalinger via en abonnementsform på ubestemt tid, indtil den annulleres af dig, på de abonnementsvilkår, der er angivet i denne aftale. Du kan til enhver tid opsige dit abonnement. Du vil ikke blive opkrævet for annulleringen. Du kan til enhver tid melde dig til igen efter din opsigelse, men vi forbeholder os retten til ikke at tillade en tilmelding, hvor vi tidligere har valgt at opsige et abonnement af dig.

 

Vi forbeholder os retten til, efter vores absolutte skøn, ikke at forny dit abonnement på noget tidspunkt og uden at give nogen begrundelse herfor.

 

Betaling og pris

Via. webshoppen kan du betale for dine varer og bruge følgende betalingsmuligheder:

Alle priser på https://clutchcognition.com er oplyst i DKK inkl. moms. Beløbet hæves først, når varerne sendes fra vores lager. Der kan aldrig trækkes et større beløb end det, du har godkendt ved købet.

 

Vi forsøger altid at sikre, at alle priser på vores hjemmeside er korrekte, men hvis vi opdager en “åbenlys fejl” i prisen på varer, du har bestilt, kan vi vælge at informere dig og give dig mulighed for at genbekræfte din ordre til den rigtige pris, ændre den, eller blot at annullere den. Hvis vi ikke kan kontakte dig, behandler vi ordren som annulleret. Hvis du fortryder og allerede har betalt for varerne, vil du modtage fuld tilbagebetaling.

 

Levering

Levering af varer bestilt fra Clutch Cognition ApS, anses for sket, når du som køber har fået udleveret varen. Risiko og ansvaret for varen overgår først til køberen ved udlevering af varen.

 

Der er mulighed for levering med Postnord og GLS til nærmeste pakkeshop, privatadresse eller på et andet anvist opbevaringssted.  Levering til privatadresse sker typisk indenfor 2-4 arbejdsdage. For virksomheder (B2B salg) leveres varen typisk inden for 5 arbejdsdage i Danmark (levering med fragtmand).

 

Retur- og fortrydelsesret

Vi har ikke en fortrydelsesret for drikkevarer, jf. forbrugeraftaleloven §18 underafsnit. 2. Dette er af hensyn til kvalitet og hygiejne, da vi ikke kan garantere, at produktet har været opbevaret korrekt efter levering, og derfor kan vi ikke så inde for kvaliteten i henhold til videresalg.

 

Reklamation og klage

Eventuelle fejl eller mangler ved varer købt fra Clutch Cognition ApS skal informeres om i rimelig tid efter, at du har opdaget fejlen. Det er din pligt, som forbruger at angive og vise, hvordan fejlen eller manglen ytrer sig. Hvis du opdager en fejl, skal du hurtigt rette henvendelse til Clutch Cognition ApS via. support@clutchcognition.com
